1. About these terms
These terms govern your use of the Mumblebone Digital Catalogue at digicat.mumblebone.com.au (the "site"). The site is operated by Mumblebone ("we", "us", "our"). By using the site you agree to these terms. If you do not agree, please do not use the site.
2. What the site is
The site is a digital sale catalogue. It lets visitors browse upcoming and past lots, view photos, videos, ASBVs and pedigree information, build a private shortlist, and add personal notes. The site is provided free of charge.
The site does not conduct auctions or accept bids.Sales are conducted at the physical sale or via the auction platform listed on the relevant sale page. Bidding, payment terms, delivery and any other sale conditions are governed by the conditions of sale issued separately for each event.
3. Eligibility
You must be at least 18 years old to create an account. By creating an account you confirm that the information you provide is accurate.
4. Your account
- Keep your password confidential. You are responsible for activity that happens under your account.
- Tell us promptly if you suspect unauthorised access to your account.
- One person, one account. Don't share accounts or impersonate another person.
- You can delete your account at any time by emailing us. We will action deletion within 30 days.
5. Acceptable use
When using the site you agree not to:
- Scrape, crawl or systematically download data beyond what the site is designed to provide. Refer to robots.txt and the published sitemap.
- Bypass authentication, attempt to access another user's notes or favourites, or probe the site for security vulnerabilities without our written permission.
- Use the site to send spam, phishing or other harmful content.
- Resell, republish or commercially exploit catalogue information without our written permission. Personal use, including printing your shortlist for a sale, is fine.
- Use automated tools (bots, scripts) to interact with the site, except for well-behaved search-engine crawlers.
We may suspend or terminate accounts that breach these rules, with or without notice.
6. Catalogue information
We publish ASBVs, pedigree, photos, videos and other information about each lot in good faith. ASBV figures are calculated and supplied by Sheep Genetics and may be updated as new measurement data arrives. Photos and videos are taken before the sale and may not reflect the exact appearance of an animal on sale day.
The catalogue is provided for information only. It is not a contract of sale, an offer to sell, or a warranty about any specific animal. Do your own due diligence and inspect lots before bidding.
7. Your content
Private notes you write against a lot remain yours. You grant us a non-exclusive licence to store them and display them back to you across your devices, for as long as you keep your account. We do not share your notes with other users or any third party.
You are responsible for the content of your notes. Do not write anything defamatory, unlawful, or that infringes someone else's rights.
8. Intellectual property
Mumblebone branding, photography, video, written content and site code are owned by us or our licensors. You may view, print and save catalogue information for your personal use in connection with a sale. You may not copy, redistribute, modify or commercially exploit our content without written permission.
9. Third-party services
The site embeds and links to services we do not control, including YouTube (for lot videos), AuctionsPlus and Sheep Genetics. Their own terms apply when you use them. We are not responsible for the availability or accuracy of third-party services.
10. Privacy
We collect and use information about you as set out in our Privacy policy. By using the site you consent to that collection and use.
11. Disclaimers
The site and the information on it are provided "as is" and "as available". To the maximum extent permitted by law:
- We do not warrant that the site will be uninterrupted, error-free, or available at any particular time.
- We do not warrant that information on the site is complete, accurate, or up to date at every moment.
- We do not warrant that the site or any data you receive from it is free of viruses or other harmful code.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (ACL) that cannot be excluded.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for:
- Indirect, incidental, special or consequential loss arising out of your use of the site.
- Loss of profits, revenue, data, goodwill or business opportunity.
- Decisions you make based on catalogue information, including bidding decisions at any sale.
- Acts or omissions of third-party services such as YouTube, AuctionsPlus or Sheep Genetics.
Where our liability cannot be excluded but can be limited, our total liability to you is limited, at our option, to resupplying the site or paying the cost of having it resupplied. This does not limit any rights you have under the Australian Consumer Law that cannot be excluded.
13. Indemnity
You agree to indemnify us against any claim, loss or expense we suffer or incur as a result of your breach of these terms or your misuse of the site, except to the extent that loss is caused by our own negligence.
14. Changes to the site or these terms
We may change the site or these terms at any time. The "Last updated" date at the top shows the most recent change. Significant changes will be communicated by email to account holders. Continuing to use the site after a change means you accept the updated terms.
15. Termination
You can stop using the site at any time. We may suspend or terminate your access if you breach these terms, if continued access would expose us to legal risk, or if we discontinue the site. Where we terminate without breach by you, we will make a reasonable effort to give you notice.
16. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
17. Severability
If any part of these terms is found to be unenforceable, the rest will continue in effect. The unenforceable part will be read down to the minimum extent necessary to make it enforceable, or removed if that is not possible.
